ThrillTek Product Use Disclaimer

This Product Use Disclaimer (“Disclaimer”) is a binding agreement between you (“Customer,” “User,” “Purchaser”) and ThrillTek LLC (“ThrillTek,” “Company,” “We,” “Us,” or “Our”) regarding the purchase, receipt, installation, ownership, use, maintenance, or disposal of any products sold, manufactured, distributed, or otherwise provided by ThrillTek.

By purchasing, receiving, opening, installing, assembling, using, or interacting in any way with any ThrillTek product, you acknowledge and agree to all terms and conditions set forth herein.

Assumption of Risk and Responsibility

All products provided by ThrillTek are intended strictly for commercial use by qualified personnel or properly trained individuals. These products are inherently mechanical and/or electrical in nature and involve elements that may pose risks including but not limited to:

• Electric shock
• Fire hazards
• Mechanical injuries
• Falling components or tipped machines
• Use-related wear or part failure

Customer assumes all responsibility and liability for ensuring the proper and safe use of any product once it has left ThrillTek’s custody.

Use of any product constitutes full and unconditional acceptance of all potential risks, known or unknown.

Intended Use and Environmental Limitations

Unless otherwise stated in writing, all ThrillTek products are intended exclusively for indoor, dry, and temperature-controlled environments. Use in any outdoor or unstable setting (including areas exposed to excessive humidity, dust, grease, moisture, heat, or vibration) is strictly prohibited and voids all warranty or liability claims.

Unsupervised Access and End-User Safety

• Products are not toys and should never be accessed or operated by minors without direct adult supervision.
• ThrillTek accepts no liability for any damages, injuries, losses, or claims resulting from:
  • Unsupervised use by minors
  • Unauthorized access to machine interiors
  • Bystander interference or tampering

Improper Use, Modification, and Tampering

Any of the following actions constitute misuse of a product and fully release ThrillTek from any liability, responsibility, or warranty obligation:

• Mechanical or electrical modification of any component
• Substitution of original parts with non-approved third-party parts
• Improper voltage or circuit loading
• Physical abuse of the product
• Misuse of prize areas, controls, or interfaces
• Incomplete or improper assembly
• Failure to follow setup guides or installation instructions

Installation and Setup Responsibility

• Follow all setup instructions precisely
• Hire qualified professionals for electrical work when necessary
• Securely anchor or level equipment as required
• Inspect for stability and operational safety prior to use

Maintenance, Upkeep, and Inspection

The Customer is responsible for maintaining all products post-sale. Routine inspections must be conducted to ensure:

• Internal components are clean and secure
• No loose wires, burned fuses, or failed parts exist
• External panels and lock systems are fully intact

Failure to conduct regular maintenance voids warranty and releases ThrillTek of liability.

Disclaimers of Warranty and Guarantee

ThrillTek provides limited warranties as outlined in our official warranty documentation. Outside of those terms, the Company makes no representations or guarantees of:

• Continued functionality under varied usage
• Compatibility with future parts or accessories
• Lifespan or expected ROI

All implied warranties, including merchantability or fitness for a particular purpose, are expressly disclaimed to the fullest extent permitted by law.

Limitation of Liability

To the maximum extent allowed by applicable law, ThrillTek shall not be liable for any damages whatsoever, including but not limited to:

• Loss of income or profits
• Business interruption
• Property damage
• Physical injury or death
• Reputational harm
• Third-party claims
• Legal fees or arbitration costs

Indemnification

You agree to indemnify, defend, and hold harmless ThrillTek and its officers, employees, agents, suppliers, affiliates, and contractors from any and all claims, damages, obligations, losses, liabilities, or expenses (including attorneys’ fees) arising from:

• Your use, misuse, or inability to use any product
• Any third-party use or access of the product
• Violation of safety or code regulations
• Negligence or intentional misconduct on your part

Severability and Jurisdiction

If any part of this Disclaimer is held to be invalid or unenforceable, all remaining sections shall remain in effect. This Disclaimer shall be governed under the laws of the State of Ohio, USA. Any legal disputes must be resolved exclusively in the courts of Cuyahoga County, Ohio.

• Accept and agree to all of its terms
• Assume full responsibility for the safe and compliant use of the product
